  • The licence for the software was granted in return for the payment of a fee. This enables the right holder to obtain remuneration corresponding to the economic value of the copy of the software.
  • The right holder has granted the first acquirer the right to use the software permanently (for an unlimited period). The software was neither leased by the right holder nor was only a temporary right of use granted.
  • Any improvements and updates in the computer program downloaded by the subsequent acquirer as compared to the computer program downloaded by the initial acquirer must be covered by a maintenance contract concluded between the originator/right holder and the initial acquirer.
  • The original licence holder has rendered its copies unusable.
  • When purchasing a product key by transmitting a combination of numbers/letters in digital form, no licence for the lawful use of the program is yet transferred.
